What Do We Mean by Each Type?

  • Games of chance: Games whose outcome is determined by a random factor completely outside the player's control. Under section 6 of the Gambling Act 2005, which extends to England, Wales and Scotland, a "game of chance" includes "a game that involves both an element of chance and an element of skill", a game involving "an element of chance that can be eliminated by superlative skill", and even a game that "is presented as involving an element of chance". So in Great Britain, a mixture of skill and luck does not put a game on the skill side of the law — only the complete absence of chance does. Northern Ireland sits outside that Act; its gambling law is the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985.

The core idea is simple: with skill, you make the difference; with chance, randomness decides.

A Practical Way to Tell Them Apart

The clearest way to judge any game is to ask yourself:

  1. Does my performance improve with repetition? If practice steadily raises your results, you're looking at skill.
  2. Can I explain a win or a loss by pointing to a decision I made? Skill can be analyzed and learned; chance can't.
  3. Would a genuine expert consistently outperform a beginner? In skill-based games, the gap between expert and beginner is clear and persistent. In games of chance, everyone ends up roughly equal over the long run.
